Pete Bennett has several issues with Accenture who based a series discoveries have connections to Fremont Group and attorney Richard Stanford Kopf and the matter of Bennett vs. Southern Pacific today controlled by Union Pacific or BNSF. Of course those entanglements connect to Kinder Morgan, Enron Corporation, and when looking hard enough the SEC Investigation lost in Building on 9/11.

Kamala Harris as State Attorney General has deep involvement in the PG&E investigation, explosions and wildfires. Bennett was contracted to work on the San Bruno Explosion but things didn't work out.

By now, you've probably heard that Terry Childs was sentenced to four years in prison, as a jury determined that he violated a California statute regarding denial-of-service attacks. Childs has already spent more than two years in jail at this point, so it's likely that he will serve four to eight more months before being released, but there's no guarantee of that.

No matter how you feel about this matter, it should be clear that this sentence is unduly harsh, and the amount of time Childs spent in jail before the conviction is appalling. The wheels of justice turn slowly indeed.

There were several factors in this case that led jurors to convict Childs, but the most significant issue to me is that the San Francisco FiberWAN network that he administered suffered no outages or problems during the course of this bizarre case, with the exception of the VPN outage that occurred when the San Francisco DA's office inexplicably placed a list of active usernames and passwords into the public record, resulting in downtime to change all those passwords. Yes, Childs withheld the network's passwords in an apparent dispute with his boss, but no actual damage was done.

Worse Offenders -- Even Murderers -- Get Less Jail Time than Childs
Consider then, the case of Steven Barnes, the former IT manager for Blue Falcon Networks in San Mateo, Calif. Barnes was convicted of sabotaging Blue Falcon's IT infrastructure in 2008, receiving a sentence of one year and one day in prison and $54,000 in restitution to the company. While Childs' actions caused no disruptions, Barnes deleted all company email, caused the email servers to spew out spam, and intentionally crippled at least some servers, rendering them inoperable. He received a much lighter sentence than Childs -- and in the same court district.

Or consider the case of Yung-Hsun Lin, convicted in 2008 of attempting to destroy a critical database owned by his New Jersey-based employer, Medco Health Systems. Lin wrote code explicitly designed to destroy the database and set it to trigger on his birthday. It failed to run and was subsequently discovered by another admin. Lin received a 30-month sentence for his actions, as he deliberately and painstakingly attempted to sabotage the company he worked for, intentionally writing scripts to destroy valuable data.

If we drift outside of the IT realm, I could add story after story of murder, attempted murder, and rape sentences that are far less than the four years that Childs' received. A recent example might be found in Oklahoma, where a man received a one-year sentence for murder.

But what's done is done, and subsequent motions for retrial have been denied. Presumably, this case will come around again on appeal.

Poorly Managed San Francisco IT Department Gets a Free Pass
Also galling to me is the fact that the City of San Francisco has absolutely refused to admit any responsibility for this whole mess. The city is as much at fault in this case as Childs is -- the way that the San Francisco IT department has been run is nothing short of abysmal, and that has been pointed out time and again by anyone paying attention to this case. Plenty of dirty laundry was aired out in court as well, yet through it all, the city has had a full-court press on Childs, and being both the plaintiff and the prosecution it spared no expense to drill Childs into the ground.

Given the nature of this case, the facts as I know them, and the rest of the data surrounding this incident, I can see how Childs might have been convicted by a largely nontechnical jury. But let's face it: if the City of San Francisco was doing anything right, this never would have happened -- and if it somehow did, the case should have been able to be resolved internally, not in a courtroom. I stand by my remarks over the past few years that if this same scenario played out in a company rather than a city IT department, we'd have never heard of it, and the most probable outcome may have been termination of employment.

Instead, Terry Childs is entering his third year in jail. It's probably safe to say that the point has been made by now: When faced with dangerously incompetent management, it's best to just look for another job.

San Francisco Selects Accenture to Implement New Financial Management System
 
SAN FRANCISCO; Oct. 7, 2015 – Accenture (NYSE: ACN) has been selected following a competitive procurement process to implement a new financial management system for the City and County of San Francisco.

Pete Bennett arrested in March 2012 by officer Vessor of Walnut Creek Police. Pulled over at the downtown Safeway with Officer La Strange who earlier that year recovered Bennett's PG&E Laptop. Unknown then was the thousands of documents for the massive hydortesting project. Bennett never knew what was on his laptop until after he fixed the laptop. Stunning information that would easy pickings for your local terrorists. That actually happend in April 2012 but Bennett didn't make that connection until 2013.

Deputy Sheriff Carlos Francies drowned in Lake Tahoe, near South Lake Tahoe, while attempting to rescue a friend who appeared to be in distress.

Deputy Francies jumped from his paddleboard into the rough water to assist the man but quickly went under the surface. Another member of the group attempted to throw a life jacket to him but it did not reach him. The group was able to pull him to surface and move him to the shore, however, they were not able to revive him.

Deputy Francies had served with the Contra Costa County Sheriff's Office for 3-1/2 years.

dead man's statute, also known as a dead man act or dead man's rule, is a statute designed to prevent perjury in a civil case by prohibiting a witness who is an interested party from testifying about communications or transactions with a deceased person (a "decedent") against the decedent unless there is a waiver.

This prohibition applies only against a witness who has an interest in the outcome of the case and applies only where that witness is testifying for his own interests and against the interests of the decedent. Furthermore, the restriction only exists in civil cases, never in criminal cases.

The restriction can be waived. A waiver can occur in a number of ways:

  1. The decedent's representative fails to object to the testimony;
  2. The decedent's own representative testifies to the communication;
  3. The decedent's testimony is brought before the jury in the form of a deposition or in another form.

With respect to U.S. federal courts, Rule 601 of the Federal Rules of Evidence defers to state law the determination of whether a witness is competent to testify. [1]

About half of the U.S. States have enacted a dead man statute, more commonly referred to as the "dead man's rule." Some states have enacted compromise variations to the rule. For example, in Virginia, an interested witness may testify only as to the statements of the deceased if this testimony is corroborated by a disinterested witness. In other states, such as Illinois, the rule has been expanded to prevent an interested party from testifying about communications with a minor or a legally incompetent person.

The Texas dead man's rule, found at Texas Rules of Evidence, 601(b)reads: (b) "Dead Man Rule" in Civil Actions. In civil actions by or against executors, administrators, or guardians, in which judgment may be rendered for or against them as such, neither party shall be allowed to testify against the others as to any oral statement by the testator, intestate or ward, unless that testimony to the oral statement is corroborated or unless the witness is called at the trial to testify thereto by the opposite party; and, the provisions of this article shall extend to and include all actions by or against the heirs or legal representatives of a decedent based in whole or in part on such oral statement. Except for the foregoing, a witness is not precluded from giving evidence of or concerning any transaction with, any conversations with, any admissions of, or statement by, a deceased or insane party or person merely because the witness is a party to the action or a person interested in the event thereof. The trial court shall, in a proper case, where this rule prohibits an interested party or witness from testifying, instruct the jury that such person is not permitted by the law to give evidence relating to any oral statement by the deceased or ward unless the oral statement is corroborated or unless the party or witness is called at the trial by the opposite party.

James G. Gilliland, Jr. -

Pete Bennett software developer tangled with Oracle Corporation debating with Oracle spokesman Robert Hoffman airing on PBS during a June 2007 segment.  Bennett lost his housing just after the segment linked to a house sitting gig for a friend.  The house was slowly grinding through the downturn but Bennett suspects powers over Bennett pulled the plug on the foreclosure processing.

May 25, 1954 - October 27, 2016

James (Jim) Gilliland, Jr. passed away on October 27, 2016, at the age of 62. He was a loving husband, doting father, and cherished son and brother; a celebrated attorney; a generous philanthropist; a terrific musician and artist; and a friend to all.

Born in Pittsburgh, PA, Jim studied at Williams College, then moved to Berkeley to earn his J.D. and M.A. at UC Berkeley. There, he fell in love with a local schoolteacher named Vickie Petri: the two married in 1978 and had four wonderful children.

After a brief stint in Washington, D.C., Jim returned to the Bay Area in 1983 to work as a litigator for Khourie & Crew. A brilliant man and tireless worker, Jim rose quickly through the ranks of the firm's many iterations: he made Partner in 1985, became Managing Partner in 1994, and Chairman of Townsend and Townsend and Crew in 2001. A ten-time Northern California Super Lawyer, he represented clients including Oracle, Sony, Levi's, and Williams-Sonoma in high-profile intellectual property cases around the world. In 2010, he helped usher Townsend through a merger with Kilpatrick Stockton, and was then named Chair of the global firm's Litigation Department.

In addition to his great success as an attorney, Jim led a rich and full life. He adored his children, and imparted to them his love of music, Bay Area sports, and literature. He attended the First Presbyterian Church of Berkeley, where he sang with the Chancel Choir for over 30 years. Later in life, he dedicated himself to supporting the educational community, serving on the Board of Trustees of The College Preparatory School, the Partners Program, and Roses in Concrete Community School. He enjoyed hiking, biking, and playing golf; visiting his cabin in the Sierra Nevada mountains; making stained-glass art; traveling the world with his wife and kids; and spending time with family and friends. He will be remembered for his kind heart, bright smile, and stupid dad jokes.

Jim is survived by his wife, Vickie; his children, David, Jeffrey, Matthew, and Lisa; parents, Jim, Sr. and Carolyn Gilliland; his sister, Carol Warren; his cousins; his in-laws; and his many loving nieces and nephews. His memorial service will be held on Saturday, November 5, at 10:30am, at First Presbyterian Church of Berkeley (2407 Dana St., Berkeley, CA 94704). Donations in his memory may be made to the Partners Program (6100 Broadway Ave., Oakland, CA 94618), Roses in Concrete (4551 Steele St, Oakland, CA 94619), the West Contra Costa Public Education Fund (217C W. Richmond Ave., Richmond, CA 94801), or the charity of your choice.

 then it was about to file Amicus brief with PG&E on the bankruptcy and the proceedings the study ended up in the hospital.

 when he tried to collect his money from PG&E he was threatened with arrest at 55 Beale Street.

In July 2020 an attorney that was likely going to represent him was murdered in Southern California.

At first I believed CNN then one day I stopped believing CNN and then Contra Costa County Law Enforcement. What sealed the deal was the arrests of Commander Norman and Deputy Tanabe in regards to the Contra Costa Narcotics Taskforce stealing drugs that was once evidence. Bad evidence management means false convictions.

Bennett vs. Collins

In 2011 the FBI began arresting officers connected that happened to officers from the same investigating agency. IN reviewing many case regarding the Contra Costa County Sheriff Incident Investigator Bennett began connecting cases to investigators. His dubious eyes cast shadows upon this case and others as the during one of the FBI there was the deputy involved in several of Bennett's case. Then one day Bennett connected Gary Vinson Collins to his fathers Big-O tire Franchise located in Lafayette. Bennett knowing Collins would worked on Vitale and Horowitz's vehicles. Collins was always seeking extra contracting work. Bennett sued Collins but he was murdered like all the rest.

The domain nomoreh1b.com was owned by Pete Bennett from 2002 to 2010.  Mr. Bennett founded his grassroots activism after enduring far too many dubious calls for the dead end interview.  

At one point nomoreh1b.com was regigstered in China, Hong Kong and Japan recently moved to Australia.  

Never does it come up for sale the site just moves around the world but never back to Bennett.
